The City of Tshwane has reinstated Group Chief Financial Officer (GCFO) Gareth Mnisi after a three-month precautionary suspension linked to allegations of tender collusion and the leaking of confidential information. His return follows the conclusion of an internal disciplinary process, which ended with the issuing of a final written warning rather than more severe sanctions.
Mnisi was suspended in April after evidence presented before the Madlanga Commission of Inquiry raised allegations that he had shared confidential tender information and was involved in tender irregularities. The suspension was described as precautionary while the municipality conducted a forensic investigation into the claims.
The City of Tshwane said its council considered the findings of the forensic investigation together with an independent legal opinion during a special meeting on 9 July. According to the municipality, the council concluded that the allegations amounted to “less serious” misconduct and resolved to proceed with an informal disciplinary process under the applicable municipal regulations. That process concluded on 21 July with Mnisi accepting a final written warning, allowing him to resume his duties.
The municipality also stated that the forensic investigation did not find evidence of impropriety against Mnisi that warranted more serious disciplinary action. As a result, it informed the Johannesburg Stock Exchange of his reinstatement, as required because the city has listed debt instruments.
However, the matter remains contested. The Democratic Alliance has launched legal action seeking to overturn the council’s decision to classify the allegations as less serious, arguing that the disciplinary outcome should be reviewed. The court challenge means the political and legal dispute surrounding Mnisi’s return is not yet over.
