The National Prosecuting Authority (NPA) will formally and unconditionally withdraw all fraud and corruption charges against South African Police Service Crime Intelligence Head Lieutenant-General Dumisani Khumalo and his six co-accused this coming Friday.
The decision follows a directive by National Director of Public Prosecutions Andy Mothibi after stunning disclosures during the Madlanga Commission of Inquiry revealed that the state’s case was severely compromised and rushed to court without finished investigations.
The high profile case centered on allegations of corruption regarding the allegedly irregular promotion of Brigadier Dineo Mokwele, whom prosecutors originally claimed lacked the necessary qualifications for her senior post. However, the state’s case completely disintegrated during the inquiry hearings when former Investigating Directorate Against Corruption (IDAC) head Advocate Andrea Johnson conceded under cross-examination that Mokwele was indeed fully qualified for her role, while a key state witness admitted on the record that Mokwele had essentially been charged for a future crime.
The criminal matter was originally scheduled to sit in the Pretoria Magistrates’ Court on 3 September 2026, but following the review of the incomplete investigations, the NPA entered talks with the defense counsel to fast-track the formal end of the case.
NPA spokesperson Kaizer Kganyago confirmed that prosecutors are preparing to strike the case off the roll this Friday, noting that if any logistical scheduling conflicts arise with the defense teams, the state will utilize the September date to finalize the withdrawal.
Under the specific terms of this decision, the state is strictly barred from re-enrolling the case in the future without the express, written authorization of the NDPP.
