The Madlanga Commission of Inquiry has issued a formal legal ruling granting a conditional postponement to Major General Feroz Khan, officially rescheduling his highly anticipated in-person testimony to Monday, September 28, 2026, at 09:30.

The legal reprieve is strictly tethered to an uncompromising timeline of independent medical and procedural deadlines throughout the month of September. Under the explicit terms of the ruling, Major General Khan must voluntarily undergo an evaluation by a medical specialist agreed upon by his representatives and the Commission’s Evidence Leaders no later than Tuesday, September 8, 2026.

Following the evaluation, the independent medical professional has until Tuesday, September 15, 2026, to submit a formal report directly to the Madlanga Commission confirming whether Khan is medically unable to appear and testify.

To ensure the process moves forward without legal deadlock, the ruling includes a built-in safeguard. If both sides fail to agree on a medical specialist, the independent evaluation and report will instead be conducted by a professional nominated directly by the Chairperson of the South African Society of Psychiatrists.

Beyond the medical assessment, the ruling maintains formal pressure on the senior officer regarding his outstanding legal obligations. Major General Khan is directed to submit a statement on or before Friday, September 18, 2026, in response to the Regulation 10(6) Notices issued to him by the Commission on June 5, 2026, and August 5, 2026. However, the requirement to submit this statement remains strictly subject to the findings of the independent medical report.

The ruling concludes by establishing clear boundaries between public transparency and the right to privacy.

The Madlanga Commission has determined that the broad nature of Major General Khan’s diagnosed conditions may be legally disclosed to the public. Conversely, his detailed clinical manifestations, specific medical treatments, and personal family circumstances are ordered to remain strictly confidential.
